Goodell DeVries Obtains Defense Verdict for Registered Representative and Broker-Dealer in FINRA Arbitration

Goodell DeVries attorneys Jeffrey J. Hines and George S. Mahaffey obtained a defense verdict for a well-known registered representative and a broker-dealer in a three-day FINRA arbitration in Washington, D.C.  The claimant sought hundreds of thousands of dollars in compensatory damages for losses suffered in her investment accounts.  Mr. Hines and Mr. Mahaffey presented fact and expert testimony demonstrating that a downturn in the market, rather than the conduct of the respondents, caused the claimant’s accounts to decline in value.  Further, Mr. Hines and Mr. Mahaffey were able to convince the arbitration panel to reject the claimant’s benefit-of-the-bargain and well-managed portfolio damage arguments, having them focus instead on the purported out-of-pocket losses in the accounts.
